The man accused of breaking into Nancy Pelosi’s mansion in San Francisco and assaulting her husband with a hammer has been formally charged with the assault.
A federal grand jury indicted 42-year-old David DePape on Wednesday with assault and attempted kidnapping in connection with the October 28 break-in at the Pelosi residence.
He allegedly woke Paul Pelosi early that morning and reportedly wanted to restrain Paul Pelosi so he could take a nap while he waited for the House Speaker to return home.
He had reportedly hoped he could “kneel” the Speaker of the Democratic House.
Moments after police arrived on the scene, the indictment says, DePape hit the 82-year-old on the head with a hammer.
According to the indictment, the entire incident was captured on police CCTV footage.
DePape was arrested that night and officers at the scene found a roll of tape, white rope, a hammer, and a pair of rubber and cloth gloves.
The Canadian citizen now faces up to 50 years in prison.

According to the indictment, filed in US District Court in California’s Northern District on Wednesday, San Francisco Police Department received a call from Paul Pelosi around 2:23 a.m. on Oct. 28.
He then told officers how a man broke into his house in search of his wife, the House Speaker, and said he would wait for her to return to the mansion in San Francisco.G
By the time officers got to the scene, DePape, according to the charges, grabbed a hammer while Paul Pelosi was apparently trying to fend it off.
During the two-minute phone call, the indictment says, Pelosi made it clear that he did not know the man, while DePape could be heard in the background that his name is “David” and that he is a “friend.”
Towards the end of the call – after an operator agreed to stay on the line with Paul – he told police that the man wanted him to “get on the damn phone.”
By the time the police arrived moments later, they saw DePape—in shorts, running shoes, and a sweatshirt—and Paul “grabbing a hammer together.”
When a police officer asked what was going on, DePape is said to have replied that “all is well,” while continuing to surround Pelosi.
An officer then yelled at him to “drop the hammer,” to which he is said to have replied, “Umm no.”
Then, the indictment said, DePape pulled the hammer over his head, grabbed Pelosi and waved it “abruptly and forcefully” at the victim.
In total, the indictment says, the entire attack lasted just 15 seconds.
Police then rushed into the house, according to the indictment, and found Pelosi and DePape on the floor, DePape’s legs over the 82-year-old.
Officers were then able to restrain DePape, the indictment says, and sought medical attention “while a pool of blood swelled around Mr. Pelosi’s head.”
In a subsequent search, San Francisco police officers found a broken glass door—indicating how DePape allegedly broke into the house—as well as a roll of tape, white string, a hammer, a pair of rubber and cloth gloves, and a journal.

After the attack, Pelosi is said to have told police how DePape woke him up that night and asked where Nancy was.
He told officers he tried to explain to his attacker that she wouldn’t be home for a few days, but said he would “wait.”
