A federal judge ruled on Tuesday that former Vice President Mike Pence must testify before special counsel Jack Smith in the investigation of former President Donald Trump’s bid to overturn the 2020 election.
Federal Judge James E. Boasberg, President of the US District Court for the District of Columbia, delivered his sealed ruling in Washington on Tuesday.
Pence’s killer is in a subpoena seeking testimony. His lawyers invoked the “speak or debate” clause of the Constitution, pointing to his ceremonial role as vice president of the Senate.
The judge, who recently succeeded Justice Beryl Hoyle as the court’s Chief Justice, included some limitations in the ruling, NBC News reported, allowing Pence limited protection due to his legislative role. (It is also often invoked by legislators for protections relating to their duties and official statements.)
These restrictions will not apply to the former president’s alleged “illegitimacy”.
Pence is allowed to decline to answer questions about his actions on Jan. 6, CNN reported.

Trump has publicly and privately demanded that Pence refuse to accept votes certified by states when Congress meets to count the electoral votes on January 6, 2021.
Pence is scheduled to campaign in Iowa on Wednesday, as he prepares to run for the potential White House. Trump, who has announced a campaign to return to the White House, wrote that Pence lacks “courage” on Jan. 6.
Pence blasted his boss at a fancy dinner in Washington last month.
“His reckless words endangered my family and everyone in the Capitol that day, and I know history will judge Donald Trump,” Pence said at an annual dinner in Washington.
Pence can choose to appeal the ruling.
Several defendants who had a role on Jan. 6 were found guilty of “seditious conspiracy,” and hundreds were charged in connection with the attack on the Capitol, which came as Congress met to count the electoral votes.

A separate Manhattan grand jury is reported to be meeting again on Wednesday regarding an investigation into Trump’s “hush-up” payments that went to porn star Stormy Daniels, who claims she had an affair with him in 2006. Trump denies the affair, and has vehemently attacked Alvin Bragg Manhattan DA Alvin Bragg in online posts and at a rally with supporters over the weekend in Waco, Texas.
On Friday, it was revealed that Judge Howell ruled against Trump’s claim to executive privilege and ruled that he must testify before a grand jury in a closed order.
